Welcome to the terms and conditions of use of 9 Genres. You are confined to obeying them and choosing us as your movie distributors by agreeing to them. Please read these Terms of Use carefully, together with other rules and regulations related to payment, streaming, and content we set before distributing the movies to OTT platforms.
We prohibit illegitimate, illegal, Unauthorized Content.
As you choose us to be your OTT distributor, we do not owe to distribute any illegitimate, illegal, or unauthorized content. Would you please ensure to not use the OTT platforms for any other commercial or non-commercial purposes or in any way that:
- It is unlawful or harmful to the platform, its customers, suppliers, or other parties, as determined in 9 Genres' sole discretion.
- Breaches any agreement, policy, or other notice applicable to us or any OTT platform we approach.
- Could damage, disable, overburden, or impair the platform's functioning or interfere with any other party's use of the platforms.
Platform Terms and Conditions
By using any digital platform to feature your movies on the silver screens, you confirm that you are at least 18 years old (or the age of majority where you reside, whichever is older). You are responsible for maintaining the confidentiality of your movie content being subjected to any breach. You agree that you are responsible for all activities under your movies name.
Changes to these Terms of Use of the Platform
We may change the terms and conditions without notice to you. You are responsible for reviewing the revised Terms of Use and any applicable postings. CONTINUED USE OF THE OUR SERVICES WILL CONSTITUTE YOUR ACCEPTANCE OF THE CHANGES OR POSTINGS. We may change or delete any features, functionality, or aspect of the services in any way or any time for any reason.
Limitation of Liability
IN NO EVENT WILL 9 GENRES BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING OUT OF, BASED ON, OR RESULTING FROM THESE TERMS OF USE OR YOUR USE OF A PROGRAM SITE, EVEN IF 9 GENRES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS AND EXCLUSIONS APPLY WITHOUT REGARD TO WHETHER THE DAMAGES ARISE FROM (1) BREACH OF CONTRACT, (2) BREACH OF WARRANTY, (3) NEGLIGENCE, OR (4) ANY OTHER CAUSE OF ACTION, TO THE EXTENT SUCH EXCLUSION AND LIMITATIONS ARE NOT PROHIBITED BY APPLICABLE LAW. WITHOUT LIMITING THE GENERALITY OF THE PRECEDING SECTIONS, YOU ACKNOWLEDGE AND AGREE THAT 9 GENRES IS NOT RESPONSIBLE OR LIABLE FOR (1) ANY CONTENT; (2) ANY THIRD PARTY CONDUCT, TRANSMISSIONS, OR DATA; (3) ANY VIRUSES OR OTHER DISABLING FEATURES THAT AFFECT YOUR ACCESS TO OR USE OF ANY PROGRAM SITE; (4) ANY INCOMPATIBILITY BETWEEN A PROGRAM SITE, SERVICES, SOFTWARE, AND HARDWARE; OR (5) ANY DELAYS OR FAILURES YOU MAY EXPERIENCE IN INITIATING, CONDUCTING OR COMPLETING ANY TRANSMISSIONS OR TRANSACTIONS IN CONNECTION WITH A PROGRAM SITE. THE LIMITATIONS, EXCLUSIONS, AND DISCLAIMERS IN THESE TERMS OF USE APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
Indemnification
You release us and will indemnify, defend and hold harmless 9 Genres and its affiliates and their respective officers, directors, employees, and agents against any claim, loss, damage, settlement, cost, expense, or other liability (including, without limitation, attorneys' fees) arising from or related to (a) your breach of any representation or warranty or other obligation contained in this Agreement; or (b) any Submission (together, "Claims"). You will use counsel reasonably satisfactory to us to defend each claim. If we reasonably determine that any Claim might adversely affect us, we may take control of the defense at our expense. You may not consent to the entry of any judgment or enter into any settlement without our prior written consent, which may not be unreasonably withheld.
Termination; Access Restriction
9 Genres may terminate these Terms of Use or terminate or suspend your access to the Program Sites at any time with or without cause. Upon any termination or suspension of these Terms of Use, your right to use the Program Sites will cease immediately, and you will not be able to retrieve any information related to your account. All provisions that reasonably may be construed as surviving these Terms of Use will survive the expiration or termination of these Terms of Use.
Disputes
Any dispute or claim relating in any way to your Use of any terms and conditions agreed will be adjudicated in the state or town court and you consent to exclusive jurisdiction and venue in these courts. We each waive any right to a jury trial.
Applicable Law
By using any 9 Genres Service, you agree that applicable federal law, and the laws of the Indian Government, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and 9 Genres.
Interpreting the Terms; Assignment
Suppose any part of these Terms of Use is determined to be invalid or unenforceable under applicable law. In that case, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms of Use will continue in effect. 9 Genres may assign these Terms of Use, in whole or in part, at any time without notice to you. The section titles are solely used for the convenience of the parties and have no legal or contractual significance.
